Seattle Shuttle Service Terms & Conditions

 

Change, Cancellation, and No-Show Policy

For transfer reservations in the United States, Canada, and Puerto Rico, a change fee or late cancellation fee for sedans, SUVs, limousines, and vans of $125.00 USD will be charged to all transfer reservations changed or canceled within the minimum stated time prior to the scheduled pickup time, unless the sum of all charges that would have been incurred for the reservation is less, in which case the lesser amount applies. For hourly reservations for sedans, SUVs, limousines, and vans, the change fee or late cancellation fee is equal to the base rate times the hourly minimum*.

 

For all countries not aforementioned and where a reservation is changed or canceled within the minimum stated time prior to the scheduled pickup time, transfer reservations for sedans and MPVs will incur a fee equal to the applicable base transfer rate plus local VAT where applicable. For hourly reservations for sedans and MPVs, the change fee or late cancellation fee is equal to the hourly minimum plus local VAT where applicable*.

 

A no-show fee equal to the hourly minimum or base transfer rate for the confirmed vehicle, plus airport fee, fuel surcharge, toll(s), and parking, if applicable, will apply should the passenger fail to cancel or meet the chauffeur at the designated pickup location for all reservations*.

 

To avoid a change fee, late cancellation fee, or no-show fee, the reservation(s) must be changed or canceled in accordance with the cancellation policy noted in your email confirmation. You may either call 206-SHUTTLE (748-8853) or cancel the reservation at www.seattleshuttle.com. Outside the United States and Canada, call 206-SHUTTLE (748-8853).

 

If you experience difficulty locating your chauffeur, please call the Service Provider telephone number listed on the email confirmation. Leaving the pickup location without notifying Seattle Shuttle will result in a no-show fee.

*Applies to all reservations where the pickup location is within the local city metropolitan area. The local city metropolitan area is defined as within 75 miles of the city center. All services outside the local city metropolitan area may be assessed the actual drive time to and from the pickup location.

 

NOTE: All Special Event Change and Cancellation Policies supersede standard Change and Cancellation Policies and are noted in the email confirmation.

 

 

Garage-to-Garage Calculations

Garage-to-Garage charges are calculated by applying the applicable hourly rate commencing from the time the chauffeur departs the garage to begin service and continuing through such time the chauffeur concludes service and returns to the garage. The minimum number of billable hours appears in the estimate, however the actual billable hours may exceed the minimum. For services in Europe, a kilometer charge will also apply.

 

 

Wait Time – Airport Transfer

Wait time is not charged for commercial flights unless customers choose to deviate from proceeding to the stated customer/chauffeur meeting location. In such instances, customers are permitted twenty (20) minutes of wait time after the scheduled pickup time. Wait time beyond twenty (20) minutes will result in charges equal to the transfer base rate plus the hourly rate prorated in fifteen (15) minute intervals.

 

Wait Time – Point-to-Point Transfer

Customers are permitted twenty (20) minutes of wait time after the scheduled pickup time. Wait time beyond the twenty (20) minutes will result in charges equal to the transfer base rate plus the hourly charge prorated in fifteen (15) minute intervals.

 

 

Extra Stops

For transfer reservations, customers are allowed to make one stop, along the route, which does not exceed fifteen (15) minutes. If the stop exceeds fifteen (15) minutes, the customer will be charged the transfer base rate plus the hourly rate for the vehicle in fifteen (15) minute increments up to forty-five (45) minutes (rounded up) for the time that the chauffeur waits. If there is more than one stop, or if the one stop lasts more than thirty (30) minutes, then the trip will convert to an hourly rate.

 

 

Surface Transportation Charge (STC)

STC is a surcharge based upon various overhead expense items, some of which may not relate to the specific trip. The STC is always calculated as a flat percentage of the base rate.

 

 

Incidentals

Incidentals may include, but are not limited to, chauffeur hotel accommodations and meals, greeter fee, parking, port fee, special requests, and tolls.

 

Fuel Surcharge

For sedan, limousine, and SUV services in the United States and Canada, the Fuel Surcharge is calculated based on the Energy Information Agency’s (EIA’s) published fuel pricing forecasts. Quoted amounts may differ from billed amounts based on the forecast in effect when services are provided. Fuel surcharges for specialty vehicles, including vans, minibuses, and motor coaches, will vary.

 

Estimated Inclusive Quote

Rates quoted prior to service are only an initial estimate of the cost of services reserved. Wait time and/or additional services may change the final price.

 

Exchange Rate

Any quoted rate is based on the exchange rate in effect at the time of booking. The final bill will be calculated using the exchange rate in effect at the time of billing.

 

Airport Transfer

The charge for service between a commercial airport or FBO location and a predefined location.

 

Hourly Charge

The charge for “As-Directed” service when there is an itinerary involved or the chauffeur takes instructions from the customer; typically involves multiple stops.

 

Point-to-Point Transfer

The charge for predefined transfer from the most frequently traveled routes in a given market, separate and aside from Airport Transfers, as defined above.

 

Base Rate

The rate charged for basic transportation services before any Gratuity, STC, Fuel Surcharge, Airport Fee, International Arrival Fee, Incidental Charges, and/or Tax is added.

 

Child Safety Seats

For safety reasons of providing age and weight-appropriate equipment, Seattle Shuttle does not provide child safety or booster seats. However, customers may provide and install their own child safety or booster seats.

 

Safety Belts

Seattle Shuttle requires passengers to comply with all local laws and regulations regarding safety belts and other safety equipment.

 

Insurance

Auto liability insurance is provided for all Seattle Shuttle services. It is procured in the market in which the service is rendered and shall provide coverage no less than the statutory minimum permitted in that market.

 

Chauffeur Conduct

Seattle Shuttle maintains a zero-tolerance policy with regard to drug and alcohol use. We are committed to ensuring that our services and workplace remain free from the effects of drugs and alcohol in order to promote the health and safety of all our employees and customers.

If you suspect that a Seattle Shuttle employee or chauffeur is under the influence of drugs or alcohol, please report this immediately by calling 206-SHUTTLE (748-8853).

Pets and Service Animals

Animals may only be transported in a kennel or soft-sided pet container. In the event damage occurs to the vehicle, caused by the animal, a damage and/or cleaning fee may be charged. For passengers with disabilities traveling with a service animal, the animal does not require being transported in a kennel or soft-sided pet container.

 

Accessibility

Any hearing-impaired person, totally or partially blind person, or physically disabled person riding in any Seattle Shuttle vehicle is permitted to be accompanied by a service animal, without being required to pay an extra charge for the service animal.

Lost or Misplaced Items

Seattle Shuttle assumes no liability for any lost or misplaced personal property or any other items.

In-Vehicle Complimentary WiFi

Many of Seattle Shuttle’s vehicles offer passengers complimentary In-Vehicle access to WiFi. Any passengers who utilize the complimentary In-Vehicle WiFi understand and agree that there are significant security, privacy, and confidentiality risks inherent in accessing or transmitting information through the Internet, whether the connection to the Internet is facilitated through wired or wireless technology. These security issues range from interception of transmissions, loss of data, or the introduction of viruses or other programs that can damage your device or network. ACCORDINGLY, ALL PASSENGERS AGREE THAT SEATTLE SHUTTLE, ITS SUBSIDIARIES, AFFILIATES, PARENTS, OWNERS, INVESTORS, AND INSURERS WILL NOT BE LIABLE FOR ANY INTERCEPTION OF TRANSMISSIONS, LOSS OF DATA, FILE CORRUPTION, HACKING, OR DAMAGE TO YOUR COMPUTER OR NETWORK THAT RESULTS FROM THE TRANSMISSION OR DOWNLOAD OF INFORMATION OR MATERIALS THROUGH THE SERVICE.

 

Nondiscrimination Policy

Seattle Shuttle provides transportation based solely upon vehicle and chauffeur availability, without regard to race, sex, color, national origin, sexual orientation, religion, gender identification, disability, age, or geographic departure point or destination.

 

 

Electronic Channel Terms & Conditions

 

  1. Acceptance. Use of the Seattle Shuttle web sites at www.seattleshuttle.com (collectively, the “Web Site”), the online reservation services (the “Services”) provided by Seattle Shuttle, and the Seattle Shuttle Mobile Application (“Mobile App”), are subject to the terms and conditions of use set forth below (“Terms of Use”), which include Seattle Shuttle’s Privacy Policy, incorporated into these Terms of Use by reference. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE WEB SITE, THE SERVICES, OR THE MOBILE APP. BY USING THE WEB SITE, THE SERVICES, OR THE MOBILE APP, YOU AGREE TO THESE TERMS OF USE. IF AN INDIVIDUAL IS USING THE WEB SITE, THE SERVICES, OR THE MOBILE APP ON BEHALF OF A BUSINESS ENTITY, WHETHER AS AN EMPLOYEE, CONSULTANT, OR AGENT OF SUCH BUSINESS ENTITY, BY DOING SO, SUCH INDIVIDUAL REPRESENTS THAT THEY HAVE THE LEGAL CAPACITY AND AUTHORITY TO BIND SUCH BUSINESS ENTITY TO THE TERMS OF USE. “YOU” SHALL REFER BOTH TO THE INDIVIDUAL ACCESSING THE WEB SITE, THE SERVICES, OR THE MOBILE APP ON BEHALF OF A BUSINESS ENTITY, IF ANY, AND ANY SUCH BUSINESS ENTITY ITSELF. Seattle Shuttle MAY CHANGE THESE TERMS OF USE FROM TIME TO TIME WITHOUT NOTICE, AND SUCH CHANGES WILL BE EFFECTIVE ON THE DATE THEY ARE POSTED ON THE WEB SITE. USE OF THE WEB SITE, THE SERVICES, AND THE MOBILE APP AFTER SUCH CHANGES HAVE BEEN POSTED CONSTITUTES YOUR ACCEPTANCE OF ALL SUCH CHANGES. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT USE THE WEB SITE, THE SERVICES, OR THE MOBILE APP.
  2. Use of the Web Site, the Services, and the Mobile App. You may only use the Web Site, the Services, and the Mobile App in accordance with the Terms of Use, any posted policies and procedures that appear on the Web Site, and for lawful purposes. You agree not to use the Web Site, the Services, or the Mobile App to:
    (a) transmit any material that infringes or misappropriates any third party’s copyright, trademark, trade secret, patent, or other proprietary rights,
    (b) transmit any material that is false, inaccurate, fraudulent, or misleading,
    (c) distribute computer viruses, worms, or software intended to damage or alter a computer system without the owner’s consent,
    (d) use “auto-responders,” “cancel-bots,” or other similar mechanisms that generate excessive network traffic,
    (e) transmit any unlawful, harmful, defamatory, pornographic, obscene, vulgar, threatening, harassing, or otherwise objectionable material,
    (f) send or relay any unsolicited advertising or chain letters,
    (g) exceed your permitted access or attempt to gain unauthorized access to the Web Site, the Services, or the Mobile App, or any part thereof, or other accounts, computer systems, or networks, through login password mining or any other means,
    (h) frame any portions of the Web Site, the Services, or the Mobile App within another web site or establish links from any other web site to any page of the Web Site other than the home page, or
    (i) resell use of, or access to, the Web Site, the Services, or the Mobile App to any third party without Seattle Shuttle’s prior written consent. Seattle Shuttle reserves the right to terminate your access to the Web Site, the Services, or the Mobile App at any time without notice if we determine, in our sole discretion, that you have abused or violated any of these terms and conditions.
  3. Mobile Charges. You are responsible for payment of any costs or expenses incurred as a result of downloading and using any Seattle Shuttle Mobile App, including any operator network and roaming charges. Please check with your service provider for details.
  4. Mobile Application License. Subject to your compliance with these Terms of Use, Seattle Shuttle grants you a limited non-exclusive, non-transferable license to download and install a copy of the Mobile App on a single mobile device that you own or control and to run such copy of the Mobile App solely for your use. Unless otherwise agreed in writing, you shall not:
    (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Mobile Apps or Services in any way;
    (ii) modify or make derivative works based upon the Mobile Apps;
    (iii) create Internet “links” to the Web Site or “frame” or “mirror” the Mobile Apps or Services on any other server or wireless or Internet-based device;
    (iv) reverse engineer or access the Mobile Apps or Services in order to (a) design or build a competitive product or service, (b) design or build a product using similar ideas, features, functions, or graphics of the Services or Mobile App, or (c) copy any ideas, features, functions, or graphics of the Web Site, Services, or Mobile App, or
    (v) launch an automated program or script, including but not limited to web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses, or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of the Web Site, Services, or Mobile App.
  5. ID Number, Password, and Security. You are responsible for maintaining the confidentiality of any user ID and/or password provided to you by Seattle Shuttle for use in connection with the Web Site, the Services, or the Mobile App. You are solely responsible for all activities that occur under your user ID and/or password, and you agree to notify Seattle Shuttle immediately of any unauthorized use of your user ID and/or password or any other breach of security related to the Web Site, the Services, or the Mobile App. SEATTLE SHUTTLE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO SAFEGUARD YOUR USER ID AND/OR PASSWORD OR TO COMPLY WITH THIS SECTION.
  6. Services Seattle Shuttle’s provision of services to you (the “Services”) may be subject to additional terms, conditions, and restrictions posted on the website (the “Web Site”), the mobile app (the “Mobile App”), or otherwise communicated in writing, including via email. The Services are subject to availability, and all price quotes are estimates. Please refer to our Frequently Asked Questions page and/or the Service Terms of Use page for more information.
  7. Proprietary Rights and Communication with Seattle Shuttle
    1. The Web Site and Mobile App, including certain content, services, and underlying software, are protected by copyright, trademark, patent, and/or other intellectual property rights laws and are owned by Seattle Shuttle and/or its licensors. You agree not to copy, distribute, republish, display, post, transmit, download, or modify any content obtained from the Web Site, the Services, or the Mobile App without prior permission from Seattle Shuttle, except for downloading or printing a copy of information for the purpose of learning about, reserving, or using the Services.
    2. Except for the suggestions, ideas, feedback, or any other proprietary information deemed covered by the above, any communication or material you transmit to us, including data, questions, comments, or suggestions, will be treated as non-confidential and non-proprietary. Subject to our Privacy Policy, Seattle Shuttle may use any material you transmit for any purpose, including reproduction, publication, or broadcast. Furthermore, Seattle Shuttle is free to use any ideas, concepts, or techniques in communications sent to us for product development without compensation.
  8. Third-Party Applications The Web Site, the Services, and the Mobile App may enable you to connect with third-party applications, services, or sites not owned or controlled by Seattle Shuttle. Any dealings with third-party applications are subject to the terms of the respective provider. Seattle Shuttle is not responsible for third-party content, services, or transactions, nor for their privacy policies and practices. You are responsible for checking the terms and conditions of third-party sites prior to use.
  9. Warranty Disclaimer THE WEB SITE, SERVICES, MOBILE APP, AND ANY INFORMATION PROVIDED THROUGH THEM, INCLUDING THIRD-PARTY APPLICATIONS, ARE PROVIDED ON AN “AS IS” BASIS. SEATTLE SHUTTLE, ITS SUBSIDIARIES, PARTNERS, AFFILIATES, VENDORS, AND SUBCONTRACTORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. SEATTLE SHUTTLE DOES NOT WARRANT THAT THE WEB SITE, SERVICES, OR MOBILE APP WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
  10. Limitation of Liability IN NO EVENT WILL SEATTLE SHUTTLE, ITS SUBSIDIARIES, PARTNERS, AFFILIATES, VENDORS, OR SUBCONTRACTORS, INCLUDING THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF THE USE OF THE WEB SITE, SERVICES, OR MOBILE APP. SEATTLE SHUTTLE’S AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE GREATER OF (i) THE AMOUNT PAID BY THE USER FOR THE SPECIFIC SERVICE IN DISPUTE OR (ii) $50. THESE LIMITATIONS APPLY REGARDLESS OF THE CAUSE OF ACTION, WHETHER IN CONTRACT OR TORT.
  11. Indemnification
    You agree to indemnify and hold Seattle Shuttle, its subsidiaries, partners, affiliates, vendors, subcontractors, officers, employees, and agents harmless from any and all losses, liabilities, damages and/or costs (including reasonable attorneys’ fees) arising from any third-party claims arising from or related to your use of the Website, the Services, or the Mobile App, or your violation of the Terms of Use or the Privacy Policy.
  12. Payment
    Seattle Shuttle uses a third-party payment processor (the “Payment Processor”) to link your credit card account to pay for the Services booked on the Website and through the Mobile App. The processing of payments or credits, as applicable, in connection with your use of the Website, the Services, and the Mobile App will be subject to the terms, conditions, and privacy policies of the Payment Processor and your credit card issuer in addition to these Terms of Use. Seattle Shuttle is not responsible for any errors by the Payment Processor. In connection with your use of the Website, the Services, or the Mobile App, Seattle Shuttle will obtain certain transaction details, which Seattle Shuttle will use solely in accordance with the Privacy Policy.
  13. Privacy
    Seattle Shuttle takes the privacy of you and your information very seriously. For further information about what information we collect and how we use such information, please view our Privacy Policy.
  14. Severability
    If any part of these Terms of Use shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms of Use.
  15. Waiver; Remedies
    The failure of Seattle Shuttle to partially or fully exercise any rights or the waiver of Seattle Shuttle of any breach of these Terms of Use by you shall not prevent a subsequent exercise of such right by Seattle Shuttle or be deemed a waiver by Seattle Shuttle of any subsequent breach by you of the same or any other term of these Terms of Use. The rights and remedies of Seattle Shuttle under these Terms of Use and any other applicable agreement between you and Seattle Shuttle shall be cumulative, and the exercise of any such right or remedy shall not limit Seattle Shuttle’s right to exercise any other right or remedy.
  16. International Access
    The Website, the Services, and the Mobile App are provided from the United States of America, and all servers that make it available reside in the U.S.A. The laws of other countries may differ regarding the access and use of the Website and Service. We make no representations regarding the legality of this Website, the Services, or the Mobile App in any other country, and it is your responsibility to ensure that your use complies with all applicable laws outside of the U.S.A.
  17. Arbitration
    Any and all disputes pursuant to these Terms of Use, or otherwise between the parties, shall be submitted to binding arbitration in the State of New York in New York County in accordance with the commercial rules of the American Arbitration Association (“AAA”) then in effect. The arbitration panel shall consist of one (1) neutral arbitrator if the amount in controversy is less than $25,000; otherwise, the panel shall consist of three (3) neutral arbitrators, each an attorney with at least five (5) years of experience in the primary area of law as to which the dispute relates. The costs of the arbitration shall be shared equally by the parties, provided that the arbitrator may award attorneys’ costs and expenses to the prevailing party. The parties agree that any actions or disputes shall be adjudicated between the parties hereto and shall not be combined with any other actions or disputes of other parties. Notwithstanding the foregoing, this arbitration clause shall not in any way be deemed to limit Seattle Shuttle’s right to commence an action in an appropriate court (and without submitting to arbitration) to protect its intellectual property rights or enjoin prohibited use of the Website, the Service, and the Mobile App.
  18. Governing Law
    The laws of the State of New York shall govern these Terms of Use. Subject to the arbitration provision above, YOU HEREBY EXPRESSLY CONSENT TO EXCLUSIVE JURISDICTION AND VENUE IN THE COURTS LOCATED IN NEW YORK COUNTY, NEW YORK FOR ALL MATTERS ARISING IN CONNECTION WITH THESE TERMS OF USE OR YOUR ACCESS OR USE OF THE WEBSITE, THE SERVICE, OR THE MOBILE APP.
  19. Force Majeure
    Seattle Shuttle shall not be responsible for damages caused by delay or failure to perform, in full or in part, any of its obligations in connection with the Website, the Services, or the Mobile App provided that there is due diligence in attempted performance under the circumstances and that such delay or failure is due to fire, earthquake, unusually severe weather, strikes, government-sanctioned embargo, flood, act of God, act of war or terrorism, act of any public authority or sovereign government, civil disorder, delay or destruction caused by public carrier, or any other circumstance substantially beyond the control of Seattle Shuttle.
  20. Entire Agreement
    These Terms of Use and the other policies and terms posted on the Website set forth the entire agreement between you and Seattle Shuttle on this subject matter and supersede all other negotiations, understandings, statements, and agreements between the parties.

SMS Terms & Conditions

Explanation of Service
Seattle Shuttle Alerts are SMS messages that notify you about important transaction-related details regarding reservations you book with Seattle Shuttle (the “Service”). These may include, but are not limited to, pre-reservation reminders, notification that your chauffeur is en route to pick you up, and notification that your chauffeur is at the requested pick-up location.

 

IMPORTANT NOTE: You can always control the types of notifications you would like to receive under the account settings options of your passenger profile, accessible at www.seattleshuttle.com. If you need any assistance with these settings, feel free to contact us at our toll-free number 206-SHUTTLE (748-8853).

 

Acceptance of Terms
By using the Service provided by Seattle Shuttle, you have agreed to be bound by these terms and conditions, as well as the terms and conditions applicable to Seattle Shuttle chauffeured transportation services (which can be accessed via www.seattleshuttle.com). However, you may use Seattle Shuttle services without subscribing to Seattle Shuttle Alerts.

 

If you do not agree with Seattle Shuttle’s terms and conditions, you must immediately cease using the Service and contact us as provided below under HELP.

Terms and Conditions

 

Subscribing to the Service
Any Seattle Shuttle passenger profile with a valid mobile telephone number attached will be automatically enrolled upon set-up, unless otherwise instructed by the enroller. Any SMS notifications sent by Seattle Shuttle are for the sole purpose of providing you with important information about the Service (as described above) and are provided in compliance with all pertinent rules and regulations pursuant to the US Telephone Consumer Protection Act of 1991 and the CAN-SPAM Act of 2003.

 

In order to subscribe, please navigate to the account settings page of your passenger profile, where you will then need to provide your mobile phone number. Please note that at this time, only one mobile number may be enrolled per passenger profile.

 

You will then have the option to select which text message notifications you would like to receive as part of the Service.

 

How to Opt-In for Alerts

Use of any Seattle Shuttle service authorizes Seattle Shuttle to send Seattle Shuttle Alerts via SMS directly to your mobile device or cellular telephone, unless you choose to opt-out.

 

STOP – How to Opt-Out or End Subscription
If at any time you decide you would like to stop receiving Seattle Shuttle Alerts, you can opt-out by replying to any SMS text you receive with the word STOP from your mobile phone.

 

You can also opt-out by visiting the account settings options of your passenger profile, accessible at www.seattleshuttle.com, and changing your notification preferences.
